Cases are often based on preponderance of the evidence, and that includes when you have enough circumstantial evidence. When you have 10 things that all point to one person, it can typically be determined they are guilty more often than not. This write up is a bit misleading because it says none of the flakes on her matched anything in Charlie’s truck or apartment, which is not true. They were able to show cross contamination between a number of things on the girl and in from his car and his workshop (like a fleck of paint on her that matched paint found in his workshop). This write up has a definite bent to it to make it seem less clear than the evidence at trial–including the forensics–actually showed.

Most trials before DNA were circumstantial. Why would all these people be lying. (1) Charlie Smithart own cousin said she saw him on the road. (2) His mother at first claimed he was with her all afternoon – but she signed a receipt at the grocery store at 3:17 PM. (3) They found the same particles from his shirt on Many’s body. (4) They found Mandy’s fingerprints in his truck – when he Charlie said she had never been in his truck. David Forest is a hero and saved many children’s lives – prayers going up for him for being so brave as to come forward.

Gerry A. – very interesting that you would support someone whose own kids said he molested them – his own cousin said she saw him on the road near the body.

(1) Why would Charlie Smithart own kids say he molested them? (2) Why would his own cousin say she saw him on the road at 5 PM (3) Why would his mother lie about where she and Charlie were the date of the crime – His mother said they were home together watching TV all afternoon. But the grocery store had a receipt that she signed at 3:17 PM. (4) All these people say Charlie was elsewhere. David Deforest will always be accused by those who would support a child molester – but David did such a brave thing -probably saved other children. Shame on those – who know Charlie Smithart did this – but are saying otherwise.

I’m surprised they haven’t. It would help with solving it beyond a doubt for those who believe it isn’t already.
